These Terms of Service govern your use of the Whiskers & Whimsy websites, online store and related services. The online store is operated by Whiskers and Whimsy Inc. and powered by Shopify.

By accessing our websites, placing an order or using our services, you agree to these terms and to the policies referenced in them. If you do not agree, do not use the services.

1. ELIGIBILITY AND ACCOUNTS

You must have reached the age of majority in your province or territory to place an order, or have the permission of a parent or legal guardian.

If you create an account, you are responsible for providing accurate information, protecting your login details and notifying us of unauthorized use. You are responsible for activity conducted through your account unless applicable law provides otherwise.

2. PRODUCTS AND CAT SAFETY

We try to describe and photograph products accurately. Colours, textures, dimensions and appearance may vary slightly because of materials, manufacturing and display settings.

Product availability can change without notice. We may limit quantities or discontinue products.

Cats differ in size, behaviour, health and play style. Choose products appropriate for your cat, follow all instructions, supervise use where appropriate, and regularly inspect products for wear or damage. Stop using any product that becomes damaged or unsafe. Product information is not veterinary advice.

3. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. We may decline or cancel an order before fulfillment because of product unavailability, a material pricing or description error, suspected fraud, delivery restrictions or another reasonable cause. If we cancel an order after payment, we will issue a refund to the original payment method.

Please review product, quantity, delivery and contact information before submitting an order. You are responsible for providing complete and accurate information.

4. CANCELLATIONS

Orders may be cancelled before fulfillment. Contact us promptly at hello@whiskersandwhimsy.ca or (888) 884-2812. Once an order has been fulfilled, shipped or collected, it can no longer be cancelled.

5. PRICES, TAXES AND PAYMENT

Prices are shown in Canadian dollars unless otherwise stated. Applicable taxes, shipping charges and other order charges are calculated and displayed before checkout is completed.

Prices, promotions and availability may change without notice. A price change does not affect an order already accepted, except where a clear error has occurred and applicable law permits correction.

You represent that you are authorized to use the payment method provided. Payments are processed through Shopify and its payment providers.

6. SHIPPING AND CLICK AND COLLECT

We currently ship within Alberta only. Available delivery and studio-pickup options, charges and estimates are shown at checkout.

Delivery and processing times are estimates and may be affected by carriers, weather, supply disruptions and other circumstances outside our reasonable control.

7. RETURNS, REFUNDS AND GIFT CARDS

Most sales are final. Our Return, Refund and Cancellation Policy explains eligibility, damaged or incorrect products, approved refunds and gift-card terms. Nothing in these terms limits rights or remedies that cannot be excluded under applicable law.

8. WEBSITE USE

You may use our websites only for lawful personal or business purchasing purposes. You must not:

• Violate applicable law or another person's rights.
• Attempt to gain unauthorized access to an account, system or network.
• Introduce malicious code or interfere with website operation or security.
• Scrape, copy or extract website content or data except as permitted by law or with our written permission.
• Use our services to send spam, impersonate another person, commit fraud or submit false information.
• Circumvent security, access controls or purchasing limits.

We may restrict or terminate access when reasonably necessary to protect customers, our business, Shopify or other service providers.

9. INTELLECTUAL PROPERTY

Unless otherwise stated, the Whiskers & Whimsy name, wordmark, photographs, written content, graphics and website design are owned by or licensed to Whiskers and Whimsy Inc. They may not be reproduced, modified, distributed or used commercially without prior written permission.

Third-party names, brands and trademarks remain the property of their respective owners.

10. FEEDBACK AND REVIEWS

If you submit a review, photograph, suggestion or other content, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person's rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you voluntarily submit for reviewing, operating and promoting our business, subject to our Privacy Policy. We may remove submitted content that is unlawful, misleading, abusive or otherwise inappropriate.

11. THIRD-PARTY SERVICES AND LINKS

Our services may include technology, payment services, applications or links provided by Shopify or other third parties. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or services outside our control.

Shopify provides the technology that powers our online store, but purchases are made directly from Whiskers and Whimsy Inc. Shopify is not the seller of our products.

12. PRIVACY

Our collection, use and disclosure of personal information is governed by our Privacy Policy. Shopify also processes information used to operate and improve its services. Shopify's Consumer Privacy Policy is available at https://privacy.shopify.com/en.

13. ERRORS AND CHANGES

We may correct typographical errors, inaccurate product information, availability, pricing or other content. When an error materially affects an order, we will contact you and provide any options required by law.

We may update, suspend or discontinue website features from time to time.

14. WARRANTIES AND CONSUMER RIGHTS

Products and services are provided subject to all warranties, conditions, rights and remedies that apply under Canadian and Alberta law.

To the extent permitted by law, our websites and general informational content are provided on an as-available basis. We do not guarantee uninterrupted or error-free website operation.

Nothing in these terms excludes or limits a statutory warranty, consumer right or remedy that cannot legally be excluded or limited.

15. LIMITATION OF LIABILITY

To the extent permitted by law, Whiskers and Whimsy Inc. is not liable for indirect, incidental, special or consequential losses arising from use of the websites or services.

This limitation does not apply where liability cannot legally be excluded or limited, including rights available under applicable consumer-protection law.

16. INDEMNITY FOR MISUSE

To the extent permitted by law, you agree to indemnify Whiskers and Whimsy Inc. against third-party claims and reasonable costs arising directly from your unlawful use of the services, infringement of another person's rights or material breach of these terms.

17. SEVERABILITY AND WAIVER

If part of these terms is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver of that provision.

18. GOVERNING LAW

These terms are governed by the laws of Alberta and the applicable federal laws of Canada. Any dispute may be brought before a court or tribunal with lawful jurisdiction. Nothing in these terms restricts a consumer from using rights or remedies available under applicable law.

19. CHANGES TO THESE TERMS

We may update these terms to reflect changes to our services, business or legal obligations. The revised terms will be posted with an updated date. Changes apply prospectively unless applicable law requires otherwise.
